Flemish term

de ene bij gebreke aan de andere

Flemish to English Law/Patents Law (general) judgment/ruling, court case, appeal

Looking for the right legalese, folks. We've come up with: "To order the defendants jointly and severally, in solidum, *one defendant for lack of the other*, to pay ..."

the one in the absence of the other, (to pay the ,.....)

common option that is used, not only one

You\'ve already said to order the defendants so don\'t repeat it later in the sentence, \"one\" is clear enough and better for the flow IMO
