Source text - Spanish A título meramente enunciativo y no exhaustivo son elementos comunes de la Comunidad de Propietarios, los siguientes:
a.Solar donde está edificado el Conjunto Residencial, su vuelo, su suelo y toda la edificabilidad no consumida que reconocida por el planeamiento en cada momento.
b.Cimientos y estructura.
c.Paseos y jardines de planta 1.
d.Fachadas y cubiertas.
e.Portales y escaleras.
f.Gimnasio, Spa, instalaciones deportivas, incluidas las piscinas exteriores y dependencias comunes a tales instalaciones.
g.Accesos y vías de circulación interiores.
h.Instalaciones Generales del Complejo Residencial: ascensores, patinillos, ventilaciones, bajantes, canalizaciones horizontales y verticales, sistema de seguridad y control, sistema de riego, alcantarillado, etc...
i.Espacios técnicos y de servicios, incluidas las Instalaciones Comunes de Telecomunicaciones.
j.Espacios de instalaciones en cubiertas.
Los espacios comunes antes citados deberán ser cuidados por los copropietarios y sus usuarios, como lo indica una civilizada convivencia. La Comunidad de Propietarios tendrá potestad para prohibir el uso de las instalaciones comunes a aquellos propietarios que no demuestren una debida diligencia y cuidado en el uso de los mismos. Para ello, bastará con que la Junta de Propietarios adopte la resolución por mayoría simple, siendo dicha resolución inmediatamente ejecutiva, sin perjuicio del derecho del propietario afectado a recurrirla ante los tribunales.
Si por acuerdo de la unanimidad de los propietarios cualquier elemento común se arrendase a terceros o se dedicare a la explotación, tanto los beneficios como los gastos que origine, se repartirán entre unos propietarios del Edificio en proporción a la cuota de participación de cada uno. En el supuesto de que para dicha explotación fuere preciso montar algún servicio o emplear alguna persona, el administrador hará el presupuesto necesario o propondrá a la Junta quien haya de hacerlo, para su aprobación. Si se acordare el arrendamiento, deberá firmar el contrato el Presidente, como representante de la Comunidad, pero la persona del arrendatario deberá previamente obtener el visto bueno de la Junta, que decidirá por mayoría.
Ratificando lo preceptuado expresamente en la vigente ley de propiedad horizontal, los elementos comunes no son en ningún caso susceptibles de división y sólo podrán ser enajenados, gravados o embargados juntamente con la parte privativa de la que son anejo inseparable.
Habida cuenta los diferentes usos que tienen cabida en el Complejo Residencial Ribera del Marlin, los elementos comunes de todo el complejo, según el destino al que están afectos, se dividen en elementos comunes generales, que son los que aprovechan por igual a todos los copropietarios del Complejo Residencial, y elementos comunes particulares, que son los que aprovechan exclusivamente a cada uno de los usos que tienen cabida en el Complejo Residencial, viviendas o locales de negocio.
En consecuencia, son elementos comunes particulares los que sólo sirven a las viviendas y plazas de garaje vinculadas a éstas o al conjunto de locales, así como las instalaciones y servicios que presten actualmente o que en el futuro presten servicio exclusivo e independiente a las viviendas y plazas de garaje vinculadas a éstas o al conjunto de locales.
Elementos comunes particulares de las viviendas y garajes vinculados a éstas situados en la planta baja del conjunto: tienen tal consideración los tejados y las fachadas de las viviendas, los huecos ocupados por las escaleras, los ascensores que dan acceso a las viviendas y su maquinaria, los rellanos de los ascensores y escaleras en todas las plantas, las piscinas, el SPA (incluyendo gimnasio, jacuzzi y vestuarios), la zona de máquinas con su maquinaria, los cuartos de contadores y de recogida de basuras, las rampas y zonas de maniobra de la planta de garajes vinculados a las viviendas, las zonas ajardinadas situadas a nivel de la planta baja y de las piscinas y, en general, todo aquello que sea de uso común y sirva en exclusiva a las viviendas y a las plazas de garaje vinculadas a éstas.
Estos elementos comunes particulares de las viviendas se mantendrán en proindivisión entre los propietarios de las viviendas y de los garajes vinculados a éstas, siendo la cuota de participación en los gastos de estos elementos la que se determina en el Anexo ¡ de estos estatutos.
Elementos comunes particulares de los locales: tienen tal consideración las fachadas y cubiertas de los locales y los pasillos de comunicación para carga y descarga situados en la planta baja del conjunto.
Estos elementos comunes particulares de los locales comerciales se mantendrán en proindivisión entre los propietarios de las locales y de los garajes vinculados a éstas, siendo la cuota de participación en los gastos de estos elementos la que se determina en el Anexo ¡ de estos estatutos.
Son elementos comunes generales todos aquellos que merezcan tal consideración con arreglo a las disposiciones legales, excepción hecha de los señalados en los párrafos anteriores, así como aquellos otros afectados al servicio o utilidad común. A título meramente enunciativo tendrían esta consideración el solar, los cimientos, el recinto para telecomunicaciones, los accesos comunes y el centro de gestión (incluyendo la zona de control de accesos, instalaciones y aseos).
Todos los elementos comunes generales, se mantendrán en proindivisión entre los propietarios de viviendas, locales y garajes del Conjunto, cualquiera que sea el bloque o portal al que pertenezcan. La cuota de cada propietario en estos elementos comunes generales es la que se determina en el ANEXO 1 a estos Estatutos, el cual no modifica las cuotas inicialmente asignadas en la Escritura de Obra Nueva y División Horizontal.
Uso de los elementos comunes particulares:
a)El uso de los elementos comunes particulares de las viviendas y garajes vinculados a éstas situados en la planta baja del conjunto descritos en este Artículo, corresponde exclusivamente a los propietarios de las viviendas y garajes vinculados a las mismas, con las limitaciones impuestas en estos Estatutos y el Reglamento de Régimen Interior. Los propietarios o usuarios de los locales comerciales y local aparcamiento no podrán tener acceso a dichos elementos comunes particulares.
b)El uso de los elementos comunes particulares de los locales descritos en este Artículo corresponderá a los propietarios de los locales, con las limitaciones impuestas en estos Estatutos y el Reglamento de Régimen Interior.
3.2 EXENCIONES
Los Locales Comerciales y la Finca que constituye el aparcamiento público estarán
exentos del pago de gastos de mantenimiento de los elementos comunes particulares del conjunto de viviendas, tales como:
Paseos y Jardines de planta 1
Impermeabilización de todo el forjado de planta 1 y de todo tipo de reparaciones parciales salvo las que estuvieran ocasionada por algún problema estructural ó de cimentaciones,
Piscinas exteriores.
Gimnasio-Spa.
Estas exenciones vienen derivadas de la no posibilidad de uso, por parte de estos copropietarios de los espacios y elementos comunes antes mencionados.
Las viviendas por su parte estarán exentas del pago de gastos de mantenimiento de los elementos comunes particulares del conjunto de locales comerciales y local aparcamiento público.
Los gastos necesarios para la conservación, mantenimiento y reparación de los ascensores de acceso a la planta sótano destinada a aparcamiento de acceso público serán de cuenta exclusiva del propietario del referido aparcamiento.
3.3 LIMITACIONES DE USO
a.Fachadas y Cubiertas y ventanas. Con carácter general, las fachadas y cubiertas son elementos comunes no modificables, Por lo tanto, no se admite el agregado de ningún tipo de cierre horizontal ó vertical, salvo los salvo los toldos aprobados por la Comunidad de Propietarios.
Queda expresamente prohibido:
La colocación de antenas parabólicas, aparatos de aire acondicionado y cualquier otro elemento fijado a las fachadas.
Todo tipo de rótulos, carteles y/o anuncios (tanto en fachadas como en ventanas)
Tender y secar ropa en toda la extensión de la fachada, sobre las barandillas ó en tendederos portátiles en terrazas, visibles desde el exterior.
La colocación de cualquier tipo de objetos, decorativos o de otra naturaleza, en los alféizares de las ventanas.
b.Toldos: Al tratarse de una zona de vientos intensos, la Comunidad ha estudiado y aprobado el tipo y modelo de toldos más seguros. Por tanto, necesariamente éstos serán iguales en todo el complejo y respetarán tipo, modelo, color y características aprobados.
Cualquier infracción en este tema deberá ser inmediatamente subsanada por el correspondiente propietario.
c.Ventanas Velux de cubiertas: Las cortinas y persianas de estas ventanas, serán asimismo del modelo y color aprobado por la Comunidad de Propietarios.
d.Terrazas. Se deberá mantener en todo momento el uso aceptado de las mismas y con mobiliario ajustado a su uso.
No estará permitido depositar y/o colgar otros elementos, no de mobiliario, como bicicletas, tablas de patinar, material recreativo náutico, etc...
Estará expresamente prohibido:
El almacenamiento de todo tipo de embalajes y basuras.
Ropa tendida sobre barandillas y en tendederos portátiles (ya que cada vivienda posee su propio espacio tendedero contigua a la cocina)
La instalación y realización de barbacoas u otras actividades que, por sus emisiones molesten a los vecinos ó provoquen daños, desperfectos ó suciedad en las fachadas.
Cualquier modificación en la iluminación de las terrazas deberá ser aprobada por la Comunidad, a fin de evitar posibles molestias a los vecinos.
En terrazas de planta 1 se prohíbe ampliar el solado de las mismas así como realizar cualquier tipo de cerramiento horizontal ó vertical.
La separación entre terrazas de planta 1, está planteada con vegetación, ayudada en caso necesario, con soportes de mallas de acero inoxidable aprobadas por la Comunidad de Propietarios.
e.Paseos y Jardines de la Planta 1ª:
El uso y disfrute de los espacios comunes deberá ajustarse a las normas de buena convivencia.
La plaza, senderos y zonas de estar, podrán ser utilizados como espacios de descanso, convivencia y paseo, obligándose los usuarios a mantener una actitud siempre decorosa y de respeto hacia los demás propietarios del complejo.
Se espera la colaboración de todos en la conservación de los jardines que son mantenidos para disfrute general.
El presidente podrá autorizar el uso de los elementos comunes de la planta 1ª para algún evento ó festejo de la Comunidad, siempre que esta circunstancia se realice en condiciones tales que no ocasione molestias al resto de los copropietarios.
En ese sentido queda expresamente prohibido en estos jardines y espacios comunes:
Colocación de piscinas, ya sean fijas o portátiles, hinchables o rígidas.
Comer y beber
Depositar desperdicios de cualquier índole, salvo en las papeleras.
Practicar deportes ó juegos de pelota
Ocasionar ruidos que puedan molestar a la Comunidad.
f.Conservación de los Jardines:
Estos jardines serán atendidos por un equipo de profesionales especializados en plantación, riego, condiciones de tierras, detección de enfermedades, etc...
Dicho equipo establecerá los tratamientos fitosanitarios y la colocación de los necesarios abonos anuales, fijando los calendarios, El mismo equipo profesional será el encargado de dar instrucciones a los jardineros, así como de supervisar las labores de mantenimiento, poda y reemplazo de especies vegetales.
Al tratarse de una “cubierta ajardinada” queda expresamente prohibida la implantación de especies tropicales por su excesivo consumo de agua y de especies con un fuerte sistema radicular por el daño posible a las impermeabilizaciones.
El reemplazo de especies vegetales muertas por otras, será exclusivamente competencia de los responsables del mantenimiento del jardín, no pudiendo ningún propietario efectuar ninguna labor de plantación, poda ó jardinería.
g.Gimnasio – Spa y Piscinas Exteriores
Todo usuario estará obligado a velar por el buen estado de conservación de instalaciones y servicios, impidiendo ó denunciado todo acto que vaya en deterioro de las mismas y advirtiendo a los responsables de cualquier anomalía en el funcionamiento de las instalaciones.
Asimismo, todo usuario estará obligado a respetar las normas que en cada momento establezca la Comunidad de Propietarios a través de su Reglamento de Régimen Interior.
h.Garajes de Viviendas y de Locales Comerciales
Los dos garajes están perfectamente delimitados con accesos vehiculares, rampas y accesos peatonales totalmente independientes.
Las superficies de las plazas de aparcamiento forman parte del título de propiedad de vivienda ó local comercial, asignadas de modo coincidente con la numeración pintada “in situ”.
Las plazas están destinadas a aparcamiento de vehículos automotores. En ningún caso puede cambiarse su destino, a menos que así lo decida la totalidad de los condueños.
Está expresamente prohibido usar la plaza de garaje para fines distintos de los de aparcamiento del vehículo, incluyéndose en esta prohibición las operaciones de lavado ó reparación del automóvil ó moto, incluso en los espacios comunes.
No se podrá, en ningún caso independizar una plaza, con ningún tipo de cierre.
i.Dominio Público.
Existe una zona de 6 metros de ancho de dominio publico, sobre los cuales no se puede construir, ni plantar vegetación ni obstaculizar el paso, dicha zona esta situada entre la viga cantil y el limite de la parcela sobre la que se ha edificado este conjunto Esta zona es de uso y dominio publico, como zona de servicios portuaria
3.4 OBRAS Y REPARACIONES. Ningún propietario podrá efectuar obras de reparación o de oto clase en los elementos comunes sin la autorización de la Junta de propietarios. Sin embargo, en casos urgentes, cuando no sea posible acudir al Administrador o al Presidente de la Junta, o cuando éste, por la causa que fuere, no las realizare, podrá el propietario llevarlas a cabo aun sin contar con su autorización, como si de un gestor de negocios ajenos se tratare.
3.5 USO. Ningún propietario podrá ser privado del disfrute de los elementos comunes salvo lo previsto en los presentes estatutos para el caso de uso negligente o doloso de alguno de los servicios de la comunidad. Podrá regularse por mayoría el modo de hacerlo siguiendo en este particular las normas que consten en el reglamento interno.
3.6 MEJORAS E INNOVACIONES. Respecto a las posibles innovaciones, y como aclaración a lo que dispone el artículo 10 de la Ley, se establecen las siguientes normas:
Cualquier propietario podrá exigir las innovaciones que fueren necesarias para la conservación y habitabilidad del Complejo y su rango, sin que sea preciso acuerdo de la Junta, si bien deberá notificarse a ésta la necesidad de las obras, para que se adopten las medidas oportunas en cuanto al modo de llevarlas a cabo.
Las innovaciones no requeridas para la adecuada conservación y habitabilidad del Complejo no podrán variar el aspecto arquitectónico del mismo, habrán de acordarse en junta mayoritaria, salvo que deba crearse alguna servidumbre sobre un elemento privativo, en que se exigirá las cuatro quintas partes de propietarios. Una vez efectuada la innovación, se reglamentará su uso por los propietarios que la realizaren, sin tener en cuenta a los disidentes, hasta que éstos decidan por aceptarla y paguen su parte proporcional.
Las innovaciones a que se refiere el apartado anterior, cuya cuota de instalación no exceda del importe de una mensualidad de gastos comunes, podrán ser impuestas a los propietarios disidentes, que habrán de contribuir a los gastos de instalación y mantenimiento aunque no puedan beneficiarse de ellas. No podrá hacerse más que una innovación de este tipo al año.
Si la innovación hiciere inservible alguna parte del edificio para el uso y disfrute de su propietario, no podrá llevarse a cabo. Sin embargo, tratándose de una inutilidad parcial, ha de tener cierto contenido, lo mismo que si se tratara de una incomodidad. Será en tal caso la Junta de propietarios la competente para decidir estos extremos por mayoría.
3.7 MANTENIMIENTO Y GASTOS COMUNES
A efectos de la participación en los elementos comunes generales y particulares, las cuotas de participación que corresponden a cada elemento privativo en los gastos de mantenimiento de cada grupo de gastos serán las fijadas en el Anexo 1. Con arreglo a ellas habrá de efectuarse el reparto de gastos que se originen, sea cual fuere la causa de éstos. A estos efectos, cada año el Administrador preparará los siguientes presupuestos de gastos:
Presupuesto de participación en gastos comunes particulares de las viviendas y plazas de aparcamiento anexas a las mismas.
Presupuesto de participación en gastos comunes particulares de los locales comerciales.
Presupuesto de participación en gastos comunes específicos del aparcamiento público.
Presupuesto de participación en gastos comunes generales de todo el complejo residencial.
Con carácter general, los gastos y servicios se imputarán a los subgrupos (viviendas, locales comerciales, aparcamiento público) o al conjunto general según su utilidad o aprovechamiento. Aquellos gastos por elementos o servicios actuales o futuros que aprovechen exclusivamente a un subgrupo serán imputados a dicho subgrupo. Los que sean de aprovechamiento o utilidad común, se imputarán a toda la comunidad de propietarios. Corresponderá al Administrador la imputación de dichos gastos o servicios a un subgrupo o a la comunidad general, sin perjuicio del derecho de revisión que corresponde a la Junta de Propietarios a la hora de aprobar los presupuestos de gastos de la comunidad.
Con carácter particular, tendrán consideración de gastos comunes generales los siguientes:
Seguridad y Vigilancia
Gasto de Administración de la comunidad
Seguro General
Gastos de electricidad
Cualquier otro que no contemplado pero que pueda afectar a todos los elementos
Tendrán la consideración de gastos comunes particulares de las viviendas, entre otros, los siguientes:
Mantenimiento, conservación y reparación de 21 ascensores de acceso a las viviendas.
Mantenimiento y gastos para el uso y disfrute de piscinas en superficie (reservado solo para propietario de viviendas)
Gastos relacionados con zona de SPA y piscina cubierta climatizada
Electricidad de esta zona de viviendas (portales, zona de espacios públicos en planta 1ª)
Mantenimiento de instalaciones de zona de viviendas
Socorristas
Mantenimiento de puertas de garaje de acceso a parking de viviendas y rampas de acceso.
Mantenimiento de puertas de acceso peatonal a zona de viviendas.
Cualquier otro que no afecte a otro elemento común distinto.
Translation - English By way of information and without limitation the following are communal features of the Community of Owners:
a.Site where the Residential Complex stands, its projection, its land and all of the unused buildable land which is recognised by Town Planning at all times.
b.Foundations and structure.
c.Footpaths and gardens of the first floor.
d.Façades and roofs.
e.Main doors and staircases.
f.Gymnasium, Spa, sport facilities, including the outdoor swimming pools and the communal buildings for such amenities.
g.Interior traffic entrances and routes.
h.The General Installations of the Residential Complex: lifts, small yards, ventilation shafts, drain pipes, horizontal and vertical drainage, security and monitoring system, watering system, sewer system etc...
i.Technical and service areas, including the Communal Telecommunications Installations.
j.Areas of indoor amenities.
The aforementioned communal areas must be maintained by the co-owners and the people that use them, reflecting civilised cohabitation. The Community of Owners will have the legal authority to forbid the use of communal installations for those owners that do not display the necessary diligence and care in their use. In order for that to happen it will be sufficient for the Board of Owners to reach a simple majority decision, with this decision being immediately enforceable, without detriment to the right of the affected owner to appeal against it in court.
If by an unanimous decision of the owners any communal feature is leased out to third parties or is used for a business, the profits as well as the costs will be shared out between each of the owners of the Building in proportion to their level of participation. In the case of said business requiring the setting up of a service or the employment of a person, the administrator will establish the necessary budget or will propose someone to do so for the approval of the Board. If the leasing is agreed the President must sign the contract as a representative of the Community, but the lessee must firstly obtain the approval of the Board, who will decide by majority.
Upholding that which has expressly been established by the current law on shared ownership of property, communal features cannot under any circumstances by divided and can be only be transferred, taxed or seized together with the private area to which it is inseparably linked.
Bearing in mind the different uses which the Ribera del Marlin Residential Complex has, the communal features of the entire complex, in accordance with the purpose to which they are subject, are divided into general communal features of which all co-owners of the Residential Complex make use in equal measure and private communal features, which are those which each owner exclusively makes use of for the established purposes in the Residential Complex, apartments or business premises.
Therefore, the private communal features are those which are only used for the apartments or parking spaces connected to them or to the business premises, as well as the installations and services which are currently used or in the future will exclusively and independently be used for the apartments and parking spaces connected to them or the business premises.
Private communal features of the apartments and parking spaces connected to them which are situated on the ground floor of the complex: these are considered to be the roofs and the façades of the apartments, the staircases, the lifts which give access to the apartments and the machinery of said lifts, the landings of the lifts and staircases on all floors, the swimming pools, the SPA (including gymnasium, jacuzzi and changing rooms) the area of machinery, the areas with meters and for refuse collection, the ramps and areas for manoeuvre on the car park floor connected to the apartments, the garden areas on the ground floor and by the swimming pool and, generally, all that is for communal use and which is for the exclusive use of owners of apartments and parking spaces connected to them.
The private communal features of these apartments will be maintained pro indiviso between the owners of the apartments and of the parking spaces connected to them, with the share of the expenses for these features being as determined in Appendix i of these statutes.
Private communal features of business premises: these are considered to be the façades and roofs of the premises and the linking passageways for loading and unloading located on the ground floor of the complex.
The private communal features of these business premises will be maintained pro indiviso between the owners of the premises and of the parking spaces connected to them with the share of the expenses for these features being as determined in Appendix I of these statutes.
General communal features are those which are considered as such in accordance with legal regulations, with the exception of those indicated in earlier paragraphs, as well as those others which affect service or communal use. Solely by way of information, these will considered to be the site, the foundations, the telecommunications area, communal access areas and the management centre (including the area of access management, installations and lavatories).
All of the general communal features will be maintained pro indiviso between the owners of the apartments, business premises and parking spaces of the Complex, whatever the block or building to which they belong. The share of expenses of each owner for these general communal features is as determined in APPENDIX 1 of these statutes but which does not alter the share of payments originally allocated in the Deeds of New Construction and Horizontal Division.
Use of the private communal features:
a)The use of the private communal features of apartments and the parking spaces connected to them on the ground floor of the complex described in this Article is the exclusive entitlement of the owners of the apartments and parking spaces connected to them, with the limitations imposed in these Statutes and the Internal Regulations of Procedure. The owners or users of the commercial premises and parking will not be able to access the aforementioned private communal features.
b)The use of the private communal features of the business premises described in this Article is the entitlement of the owners of the premises, with the limitations imposed by these Statutes and the Internal Regulations of Procedure.
3.2 EXEMPTIONS
The owners of the Business Premises and Building which makes up the public car park will be exempt from maintenance costs for the private communal features of the apartment complex such as:
First floor Pathways and Gardens.
Waterproofing of the entire framework of the first floor and any kind of partial repairs except for those resulting from problems with the structure or its foundations.
Outdoor swimming pool.
Gymnasium-Spa.
These exemptions are a result of the prohibition of their use by the co-owners of the aforementioned areas and features.
In turn, the owners of the apartments will be exempt from the payment of expenses for the maintenance of the private communal features of the business premises and the commercial public car park.
The expenses necessary for the conservation, maintenance and repairs of the lifts which access the basement which is used as a public car park will be the sole responsibility of the owner of the aforementioned car park.
3.3 LIMITATIONS OF USE
a.Façades and roofs and windows. In general, the façades and roofs are non-amendable communal features. Therefore the addition of any kind of horizontal or vertical shutters is not permitted apart from awnings approved by the Community of Owners.
The following are expressly forbidden:
The installation of satellite dishes, air conditioning equipment and any other item which is fixed to the façades.
Any type of signs, poster and/or advertisements (in façades as well as windows).
To hang out and dry clothing on any part of the façade, on the banisters or on portable clotheshorses on terraces which are visible from outside.
The placing of any kind of object, decorative or otherwise, on windowsills.
b.Awnings: As the area has intense winds the Community has studied and approved the safest type and model of awning. Therefore they will need to be identical in all of the complex and will conform to the approved type, model, colour and features.
Any infraction of these conditions must be immediately rectified by the corresponding owner.
c.Velux skylight windows: The curtains and shutters for these windows will be of the model and colour approved by the Community of Owners.
d.Terraces. One must always make acceptable use of terraces and have appropriate furniture for this use.
It is not permitted to leave and/or hang other, non-furniture, items such as bicycles, skateboards, recreational nautical equipment, etc.
The following are expressly forbidden:
The storage of any kind of packaging or rubbish.
Clothing hung on banisters and on portable clotheshorses (given that each apartment has its own space to hang clothes next to the kitchen).
Setting up or holding barbecues or other activities which, by their emissions, disturb neighbours or dirty or cause damage or imperfections to the façades.
Any modification to the lighting on terraces must be approved by the Community with the aim of avoiding disturbance to neighbours.
On terraces on the first floor it is forbidden to expand their surface area as well as adding any vertical or horizontal shutters.
The division between terraces on the first floor contains plants, supported when necessary with stainless steel meshes approved by the Community of Owners.
e.Pathways and gardens of the 1st floor:
The use and enjoyment of communal spaces must be subject to the norms of good cohabitation.
The square, paths and living area can be used as areas of rest, for cohabitation and to stroll, with those that use them obliged to behave in a decent and respectful manner towards the other owners of the complex.
Everyone is expected to cooperate in the conservation of the gardens which are maintained for the enjoyment of all.
The president will be able to authorise the use of the communal features of the first floor for Community events or celebrations, as long as this is carried out in a way that does not disturb the rest of the co-owners.
Bearing this in mind the following are expressly forbidden in these gardens and communal spaces:
The laying down of swimming pools, whether they be fixed or portable, inflatable or otherwise.
Eat and drink.
Drop litter of any kind, except for in the bins.
Practise sports or ball games.
Make noises which might disturb the Community.
f.Conservation of the Gardens:
The gardens will be attended by a team of professionals who are experts in planting, watering, soil conditions, the detection of plant illnesses, etc.
This team will determine the necessary phytosanitary treatment and annual amounts of fertilizer needed organising the calendar. The same professional team will in charge of giving instructions to the gardeners as well as supervising the maintenance work, the pruning and replacing of plants.
When dealing with a “roof garden” it is expressly forbidden to plant tropical species due to their excessive consumption of water and species with a strong root systems due to their potential damage to the waterproofing.
The replacement of dead plants for others is the exclusive responsibility of those in charge of maintaining the garden, with no owner being permitted to carry out any planting, pruning or gardening.
g.Gymnasium – Spa and Outdoor Swimming Pools
All users are obliged to maintain the good condition of the installations and services, preventing and reporting any action which damages them and warning those in charge of any anomaly in the functioning of the installations.
Likewise, all users are obliged to respect the norms which are at all times established by the Community of Owners in their Internal Regulations of Procedure.
h.Apartment and Business Premises Parking Spaces
The two car parks are perfectly delimited with entirely independent vehicular access, ramps and pedestrian access.
The parking space areas are part of the property deed of the apartment or business premises, allocated in such a way as to coincide with the number painted “in situ”.
The spaces are intended for the parking of auto motor vehicles. This purpose cannot be changed under any circumstances without the agreement of all co-owners.
It is expressly forbidden to use the parking space for anything other than parking the vehicle, including washing or repairing the car or motorbike, even in the communal spaces.
Under no circumstances may the space be made independent of others with any type of shutters.
i.Public Domain
There is an area, six metres in width, of public domain on which it is not permitted to build nor plant seeds nor obstruct the passage. This area is located between the capping beam and the border of the land on which this complex was built. This area is of public use and domain, like port services.
3.4 WORKS AND REPAIRS. No owner is permitted to carry out repairs or any other kind of work on the communal features without the authorisation of the Board of owners. However, in the case of emergencies, whatever the cause, the owner will be able to carry them out without authorisation as if he or she were working for an outside company.
3.5 USE. No user can be deprived of the use of the communal features except for under the conditions described in the present statutes in the case of negligent or inappropriate use of any of the community's services. The way in which this is done can be regulated by a majority decision, following the norms set out in the internal regulations.
3.6 IMPROVEMENTS AND RENOVATIONS. Regards possible renovations, and on a point of clarification of that which is stipulated in article 10 of the Law, the following norms are established:
Any owner can demand any renovations which are necessary for the conservation and habitability of the Complex and within its limits, without the necessary agreement of the Board, although he or she must notify the Board of the need for the works, so that the appropriate measures are taken to carry them out.
Renovations which are not required for the adequate conservation and habitability of the Complex cannot alter its architectural appearance. It would be necessary to have the backing of the majority of the board, unless an easement is created for an exclusive feature, which will require the support of four fifths of the owners. Once the renovations are carried out only the owners who carried them out will be able to use them, and not those who dissented, unless they decide to accept them and pay their share of the costs.
The renovations referred to above, at a cost which does not exceed a total of a month's community expenses, can be imposed upon the dissenting owners, who will have to contribute to the costs of installation and maintenance even though they do not benefit from them. No more than one renovation of this type can take place per year.
If the renovation makes any part of the building unusable for its owner, it cannot be carried out. However, if it is only partially unusable, it must be accommodated to some extent, as if it were simply an inconvenience. In that case it will be the responsibility of the Board of owners to decide these details by majority vote.
3.7 MAINTENANCE AND COMMUNAL EXPENSES
Regards contributions for general and private communal features, the expenses for each exclusive feature will be those which are established in Appendix 1. In accordance with this, expenses which arise must be shared out, whatever their cause. For this purpose, each year the Administrator will prepare the following expense budgets:
Budget of contributions for private communal expenses of apartments and parking spaces connected to them.
Budget of contributions for private communal expenses of business premises.
Budget of contributions for communal expenses specific to the public car park.
Budget of contributions for general communal expenses for all of the residential complex.
In general, expenses and services are charged to subgroups (owners of apartments, business premises, public car park) or to owners as a whole, depending on their use and purpose. Those expenses for features or services, present or future, which are used exclusively by a subgroup will be charged to that subgroup. Those which are for communal use will be charged to the community of owners as a whole. The Administrator will be responsible for charging a subgroup or the community as a whole for these expenses and services without prejudice to the right of revision which is the responsibility of the Board of Owners when budgets are approved for community expenses.
The following will specifically be considered general communal expenses:
Security and Surveillance
Community Administration costs
General Insurance
Electricity costs
Any other expense which is not listed but which affects all features
The following are, amongst others, considered private communal expenses:
Maintenance, upkeep and repairs to the 21 lifts which allow access to apartments.
Maintenance and expenses for the use and enjoyment of swimming pools (reserved solely for owners of apartments).
Expenses related to the SPA and heated indoor swimming pool area.
Electricity for some areas of apartment buildings (main doors, public spaces on first floor).
Maintenance of installations of apartment buildings.
Lifeguards
Maintenance of garage doors which access apartment car parks and access ramps.
Maintenance of pedestrian entrances for apartment buildings.
Any which does not affect another, distinct, communal feature.
