The court has to hold a directions hearing to give instructions to both sides in relation to the date of the forfeiture hearing, time estimate of the hearing, service of evidence and any other matters dealing with the management of proceedings.

Confiscation/forfeiture is the next stage, after inquiries reveal that the money or goods are liable to fall forfeit to the State (because, for example, they are the proceeds of a crime). Confiscation/forfeiture involves change of ownership from the original owner to the State. (The very word confiscation contains the term “fisc” – i.e. the State Treasury – this is how to remember it, the State takes on ownership of confiscated goods or money).
