Harassment v stalking

Kako razlikovati ta dva pojma?

A person must not pursue a course of conduct—
(a)which amounts to harassment of another, and
(b)which he knows or ought to know amounts to harassment of the other.

A person's course of conduct amounts to stalking of another person if—
(a)it amounts to harassment of that person,
(b)the acts or omissions involved are ones associated with stalking, and
(c)the person whose course of conduct it is knows or ought to know that the course of conduct amounts to harassment of the other person.

the main difference between "harassment" and "stalking" is that "stalking" can be done without the person targeted being aware at all of the stalking, while someone being "harassed" definitely can not avoid being aware of the "harassement".

In my understanding "узнемиравање" and "прогањање" would just be different levels of "harassment". "Stalking" is more "(опсесивно) праћење".

Prvo je uznemiravanje, a drugo je proganjanje.

U Republici Srbiji, drugo je kriminalizovano kao posebno krivično delo, dok se prvo prepoznaje tek kao element nekih krivičnih dela i prekršaja, pa nema baš neposrednu paralelu.
