My Issue: I have a concern regarding the term "協議" which can be translated to either "consultation" or "agreement". I'm unsure if I should use the word "mutual" before "consultation" or if the intended meaning is already clear between the two parties involved.

There are a number of ways of translating 協議のうえ, but 'by mutual agreement' feels most appropriate to me in this context.

I also agree with Mitsuyoshi's answer that you don't actually have to say 'mutual' - just 'by agreement' would also be fine.
