Italian term

per sorte (in context)

Italian to English Law/Patents Law (general) financial court case
"l'istante è creditrice dell'intestato Fallimento dei seguenti importi: Euro xxx = per sorte in virtù del decreto ingiuntivo emesso xx/xx/2012"

"sorte" = la parte spettante a ciascuno di un'eredità, di un guadagno ecc. But given it also means 'fate', just hoping it's not something to do with a lottery or auction system.

It might just mean 'a [capital] amount', in which case I can just leave it out.

per sorte is redundant here, since you are a legal translator, you know how redundand can be Italian legalese :)

Inheritance by lot/allocation

"The petitioner is a creditor of the intestate bankruptcy to the following amounts of Euro xxx- by lot/allocation under the injunction issued on XX/XX/2012"

"inheritance" = each person's share of an inheritance, profit, whatever.
Note from asker:
I don't think it's 'intestate' (inheritance) from the context, but rather 'named' or 'registered'. But yeah I see now 'lot' is to 'lottery' what 'sorte' is to 'sorteggio'! Thanks.

Italian term (edited): per sorte

by reference to capital sums

- not a good idea to leave out, even 'when in doubt' if refers to the amounts of principal - minus interest - the applicant as creditor of the estate is after.

Otherwise, could mean by 'drawing of lots'.

Though my professional indemnity insurance for clangers has 'run off', I subscribe to the school of thought that says 'There are no true synonyms, nor redundancies in law.'
Example sentence:

Per sorta capitale si intende chi paga le spese, termine giuridico, per sorte capitale si intende il *puro capitale*, l'entità dello stesso, è un termine desueto .
