failure to declare employees / employing undeclared workers

undeclared work means any paid activities that are lawful as regards their nature, but not declared in conformity with national law and practice. In any case, this definition must not be more restrictive than the legislation in force in each Member State;

Nota Bene: "any paid activities that are lawful as regards their nature" - not quite the same as "undocumented" workers, where the "lack of documents" is not about "forgetting" to notify the authorities, but about the employed workers not having the right "documents" i.e. "not having the right to work".

1. What is an "undocumented worker" or "undocumented immigrant?"
In the United States, an undocumented worker or undocumented immigrant is a foreign-born person who is not a permanent resident and is not a U.S. citizen. "Undocumented immigrant" may refer to a person whose immigration status is not resolved. Due to the unresolved status, the worker does not have permission to work in the United States. For information on types of immigrant status visit the U.S. Citizenship and Immigration Services website.

This term "непријављивање запослених" is about employers abstaining from declaring their workers to the relevant authorities. In Serbia, the vast majority of the "undeclared" would be perfectly entitled to work in Serbia - they would be definitely "documented".

failure to document workers/employees

neprijavljeni radnici/zaposleni are undocumented workers/employees. I think you can translate this as the failure of an employer to document their workers/employees/staff.

thanks :)
disagree Daryo : You added an element that is non-existant in the ST - no one said anything about employing people that don't have "the right to work"// Even in the US "undeclared workers" are not all "undocumented"!!

I agree that your suggestion is better but, I didn't write 'undocumented worker', I wrote the employer's failure to document a worker. There's a difference in meaning. To document - to make an official record.

Unreported Employment

"Unreported employment, often known as moonlighting, cash-in-hand or ‘under the table’ employment, is employment that the state doesn’t know about, meaning it can’t tax the employment or ensure its compliance with labour laws, health and safety regulations and industry procedures. This is seen as an advantage to the employer, who has to pay the employee less money overall, and the employee, who won’t lose money to taxation."
