Discussion

Adrian MM. Mar 8, 2022:
@ asker, David R. - collateralized ins. pols. > calling in the pledged (?) insurance policies : ... the collateralis/zed insurance policies, perhaps. Pledge IMO is over-used as translat/or/ese cf. charged vs. pledged co. shares in BrE - and always reminds me of the legendary film / movie of 'The pawnbroker' starring Rod Steiger.

Foreclosure on (liens on) insurance policies might well work in AmE / CanE. Foreclosure on charges over ins. pols. IMO wouldn't work in BrE for non-land.

As mentioned, like a 'general asssignment or, controversially, a floating charge of book debts' as collateral, our London law firm had been instructed to 'assign' life policies by en-/in-dorsement over to the lending instiution (bank or building society / AmE: mortgage corporation) for employees' home loans.

David Rumsey (asker) Mar 8, 2022:
More context Hi folks. Thanks for the input. Turns out this is some kind of "forfeiture of pledged life insurance policies." Similar to the junk mortgages sold to investors before the 2008 crash, it appears that they created similar financial "products" made of life insurance policies that they used as collateral for loans. Then the bank ended up "calling in the pledged (?) insurance policies".
Deane Goltermann Mar 8, 2022:
All I know is what I read --
I read this as someone did the *forcing*, and the bank took over through that someone.

Påtvungit even
Christopher Schröder Mar 8, 2022:
Wouldn’t it then be påtvingat? I see this as an adjective
Deane Goltermann Mar 8, 2022:
Yeah, more context I don't see your question as a single term. The 'påtvingade' is simply the verb of the sentence. The plaintiff/complainant claims someone else (or the bank? ...more info needed on this) forced/initiated the foreclosure of a lien (likely?) on the life insurance policies (?)

coercive foreclosure

I'm unsure påtvingade pantrealisationen is a term of art like a 'compulsory' foreclosure, though - without more context - can't unravel the syntax too well:

Genom den som målsäganden anser påtvingade pantrealisationen har banken övertagit livsförsäkringarna. > As a result of the foreclosure the Plaintiff / Claimant deems coerced into (query: who and why eg as a contract or 'deeded' term), the bank has taken possession of the life policies.

> foreclosure - leaves open whether the 'pant' is an assignment of the life policies themselves for a land (endowment etc.) mortgage loan etc. or a collateralization of other property, such as goods or a bank account.

Related topic: England &Wales : a court charging order ('judicial mortgage') is obtainable over company shares, insurance policies or land to enforce a judgment debt.

> post-Deane G's discussion entry, possibly : *enforcement of the lien* the Plaintiff deems (him/her/itself) coerced into.

Lien might work well for US Am. consumption as, to my understanding: like a US mechanic's lien taken over a building repaired, can be taken over land (vs. BrE: a land charge) as well as generally over ins. pols. (which I, as a City of London law clerk, used to 'assign by endorsement over' to a lender as security for a mortgage loan) or over co. shares and bank accounts etc.

Collaterization footnote:

'Collateral assignment of life insurance lets you use a life insurance policy as an asset to secure a loan. If you die while the policy is in place and still owe money on the loan, the death benefit goes to pay off the remaining debt. Any money remaining goes to your beneficiaries.'
Example sentence:

Charging orders are a useful way to secure a debt by imposing a charge over a debtor’s beneficial interest in land (securities or other assets).

Banks have, due to the limitations of what kind of property they are allowed
to hold, been subject to certain rules and regulations regarding how they can
acquire or take over pledges that are subject to a realization. However, the
law concerning these matters can be questioned as incomplete when
scrutinized. The legislator’s wording regarding banks realization of pledges
is somewhat unclear and the proposition to the law in question is only
supplying shallow instructions to how and when a realization can take place.
For example, the law does not state what the risk for a substantial loss for
the banks should constitute. The problem is also partly due to the fact that if
a pledge agreement fails to handle a certain circumstance regarding a
realization, the law on pledges does not provide a clear alternative to fill out
the agreement. This further complicates the handling of pledges in general
but it does also affect realizations made by banks. The outcome of this is
that mainly weaker parties may be affected in a negative way.
