Derecho a pedir la sustitución del Ingeniero Residente: El Contratante tendrá en todo momento el derecho de solicitar por escrito a El Contratista, la sustitución del Ingeniero Residente **cuando esté de por medio** la buena marcha de los trabajos, tanto para salvaguardar la calidad de las obras ejecutadas como para mantener la disciplina de las relaciones laborales. As mentioned above, this expression often suggests that some benefit is "at stake". i.e. the idea that "algo está en juego/en entredicho".

Compulsory nod to David for my having stolen his "smooth progress".

agree Robert Carter : "At stake" or "in jeopardy" is the key idea here. I might have gone for "productivity" for "buena marcha" here, but "smooth progress" is more colourful. Saludos Andy!

Translation: "When progress in work is in the interest of the employer"

In the middle, this is about the possibility of replacing the engineer who follows, attends and is responsible for the works.

where this might cut across /come between ( a succesful conclusion of the works being carried out)

There is a right to request replacement of the head engineer where to continue to employ this person might have a negative effect on the job's outcome, due to some incompetence or other; in other words, where his continued employment in the job cuts across or comes between a successful outcome.
