Qualora tale somma non venga pagata il legato si intende risolto a favore dell'erede universale. Immagino si tratti del testamento, dell'eredità, ma esiste un termine tecnico?

legacy? 1. The legacy is the property/money, and it goes to someone or passes to them. "The legacy will pass to xxx," "will devolve to xxx," "will be resolved in favor of xxx."

2. The will is the document, or more likely a provision in the document, and it gets resolved in xxx's favor: "this provision will be deemed resolved in favor of xxx"

I think xxx is simply getting the remainder after the somma pagata is subtracted (or if it's zero), so I would say (1). (2) is OK but maybe too complicated.

@mrafe so you would suggest to use 'the legacy is deemed to be resolved in favor of....'?

risolto I think so - resolve is how I immediately understood it. In formal US legal writing we might say "devolve" instead of risolvere. But again, "devolve" probably is not the style you would find in a holographic will.

Grazie mille, quindi mi confermate che 'legato' si riferisce al lascito, all'eredità, ma come si lega con 'si intende risolto'? Normalmente per i contratti 'risolvere' indica 'terminare' ma in questo caso, trattandosi di un testamento?

agree Adrian MM. : but not devise unless of land: the term of 'legacy' needs to be watched in Roman civil-law systems. That's why gift is often a safer option.

Thank you Adrian. Based on other posts about this source text, I think there's land & other. And it's holographic so the court would have to cut the testator some slack.
