Qualora tale somma non venga pagata il legato si intende risolto a favore dell'erede universale. Immagino si tratti del testamento, dell'eredità, ma esiste un termine tecnico?

: but not devise unless of land: the term of 'legacy' needs to be watched in Roman civil-law systems. That's why gift is often a safer option.

Thank you Adrian. Based on other posts about this source text, I think there's land & other. And it's holographic so the court would have to cut the testator some slack.

2. The will is the document, or more likely a provision in the document, and it gets resolved in xxx's favor: "this provision will be deemed resolved in favor of xxx"
I think xxx is simply getting the remainder after the somma pagata is subtracted (or if it's zero), so I would say (1). (2) is OK but maybe too complicated.
