AVUKATLIK HİZMET SÖZLEŞMESİ
I- SÖZLEŞMENİN TARAFLARI
İşbu “Avukatlık Hizmet Sözleşmesi”;
Bir tarafta “………..” adresinde mukim İstanbul Barosu’na kayıtlı Av. …… (kısaca “AVUKAT” olarak belirtilecektir.)
İle;
Diğer tarafta "…………………." adresinde mukim ……………. ( kısaca “İŞ
SAHİBİ” olarak belirtilecektir)
arasında aşağıdaki belirtilen şartlar dahilinde akdedilmiştir.
II- SÖZLEŞMENİN KONUSU
İşbu sözleşme;
AVUKAT tarafından İŞ SAHİBİ’NE verilecek avukatlık hizmeti ile bu hizmet karşılığında İŞ SAHİBİ’NİN AVUKAT’A ödeyeceği hizmet bedeline ilişkin olup, taraflar arasındaki karşılıklı hak ve yükümlülükleri kapsar.
III- SÖZLEŞMENİN HÜKÜMLERİ
1. AVUKAT, İŞ SAHİBİ’NİN ……………… ile akdetmiş olduğu ……….. tarihli “……………..” başlıklı sözleşmenin fesih işlemlerini yapacak, sözleşmenin feshini gerçekleştirecektir. AVUKAT, sözleşmenin feshi nedeni ile İŞ SAHİBİ tarafından ……… şirketine ödenen ……. EURO’nun ve sözleşmenin 6.1. maddesinde kararlaştırılan “geciken her gün için sözleşme bedelinin %0.14 ü” oranındaki cezai şartın ve sözleşmenin haklı sebeplerle feshinden dolayı talep edilebilecek olan tüm menfi ve müspet zararların ……… şirketinden tahsili için gerekli olan tüm yazışma, noter ihtarı, icra takibi ve dava süreçlerini yürütecek ve sonlandıracaktır.
2. İşbu sözleşmede sözü edilen avukatlık hizmeti karşılığında, İŞ SAHİBİ tarafından AVUKAT’A avukatlık ücreti olarak …….. EURO ödenecektir. Ön ödeme olarak söz konusu avukatlık ücretinin …….. EURO luk kısmı iş başlamadan önce İŞ SAHİBİ tarafından AVUKAT’A peşin olarak ödenecektir. Kalan ……… EURO ise iş bittikten sonra ödenecektir.
3. Tüm noter, icra müdürlüğü ve mahkeme masrafları İŞ SAHİBİ’NE ait olacaktır. İşin başlaması ve yürütülmesi için gerekli olan masraf için İŞ SAHİBİ tarafından AVUKAT’A iş başlamadan önce …….. EURO masraf ödemesi yapılacaktır.
4. İşbu sözleşmeden doğacak anlaşmazlıkların hallinde, ……… Mahkemeleri ve İcra Daireleri yetkilidir.
5. İş bu sözleşme 2 nüsha olarak düzenlenmiş olup, …/…/… tarihinde taraflarca imzalanmıştır.

ATTORNEY SERVICE AGREEMENT
I- CONTRACTING PARTIES
This “Attorney Service Agreement”
hereby has been concluded under the following terms and conditions between Atty. …….(hereafter referred to as “ATTORNEY”) who is resident at “………”, registered in Istanbul Bar Association
And;
………… (hereafter referred to as “CLIENT”) who is resident at …………….
II- THE SUBJECT OF THE AGREEMENT
This agreement;
is related to attorney service to be provided to the CLIENT by the ATTORNEY and attorney's fees to be paid by the CLIENT to the ATTORNEY in consideration of the legal services provided and it stipulates hereunder mutual rights and responsibility between the parties.
III- PROVISIONS OF THE AGREEMENT
1. The ATTORNEY shall take necessary action and carry out the termination of the contract dated …./…/, with the title "……….." which has been signed between CLIENT and the company of …………... The ATTORNEY shall follow up and conclude all necessary correspondence, written warning of the notary, execution proceeding and litigation processes in order to collect from ………….. the amount of EUR …… which was paid to ….. by the CLIENT due to the termination of the contract and to collect the penalty which is 0.14% of the contract price for each day delayed, agreed in the Article 6.1 of the contract, and to recover negative and positive loss which can be demanded due to the termination of the contract with justifiable reason.
2. The CLIENT shall pay the attorney’s fee of EUR …. to the ATTORNEY in consideration of the attorney service provided under the agreement. As a prepayment, the part of the attorney fee of EUR 5.000.00 shall be paid in cash by the CLIENT to the ATTORNEY before the commencement. The remaining balance of EUR …….. shall be paid after the work is done
3. All expenses incurred in notary, execution office and court shall belong to the CLIENT. The CLIENT shall pay the amount of EUR ……. to the ATTORNEY for the expenses required for the commencement and following the procedure.
4. In case of any conflicts arising out of this agreement, ........ Courts and Execution Offices shall be authorized.
5. This agreement has been drawn up in two copies and signed by the parties on ... / ... /...
