What is evaluation?
Evaluation is a systematic assessment of the design, implementation and outcomes of an intervention3,4. It involves understanding how an intervention is being, or has been, implemented and what effects it has, for whom and why. It identifies what can be improved and estimates its overall impacts and cost-effectiveness.

When is evaluation useful?
Evaluation can inform thinking before, during and after an intervention’s implementation.
Different questions are answered at each stage:
BEFORE – What can we learn from previous evaluations of similar interventions?5 How is the intervention expected to work? How is it expected to be delivered? Are its assumptions valid? Can it be piloted and tested before full rollout? Can the roll-out be designed to maximise potential learning?
Provides evidence that informs the intervention design, how best to implement the design and what the likely outcomes might be. Helps identify and reduce uncertainty.
DURING – Is the intervention working as intended? Is it being delivered as intended? What are the emerging impacts? Why? How can it be improved? Are there unintended consequences?
Provides evidence on the implementation of the intervention and any emerging outcomes so that it can be continually improved.
AFTER – Did the intervention work? By how much? At what cost? What have we learned about its design and its implementation? Are the changes sustained?
Provides evidence on the design, implementation and outcomes, drawing out lessons for the future and providing an assessment of the overall impact of the intervention.

입법영향분석은 입법·정책적 개입(intervention)3,4 설계, 시행 및 결과에 대한 체계적인 평가를 의미하며, 정책이 어떻게 시행되어 왔고, 어떻게 시행되고 있는지, 누구에게, 왜, 어떤 영향을 미쳤는지를 분석한다. 또한 이를 통해 개선 여지가 있는 부분을 파악하고 전반적인 영향력과 비용 효과를 추정할 수 있다.

입법영향분석의 활용 시점
입법영향분석은 사전, 중기, 사후 분석을 통해 개입 시행 시기에 따른 판단에 기여한다. 분석 단계별로 각기 다른 질문이 제시되며, 각 단계에서 해당 질문에 답하는 과정을 거친다.
사전분석 – 유사 입법 사례에 대한 사전분석을 통해 배울 수 있는 것은 무엇인가?5 개입이 어떻게 작용할 것으로 예상되는가? 예상되는 변화는 무엇인가? 가정은 타당한가? 정식 입법 전 시행할 수 있는 시범 단계가 마련되어 있는가? 잠재적 학습 효과를 극대화할 수 있도록 입법안을 설계할 수 있는가?
사전분석은 개입 설계, 설계를 구현할 수 있는 최선의 방법 및 예상되는 결과에 대한 근거를 제시하며, 불확실성을 파악하고 이를 예방할 수 있도록 한다.
중기분석 – 사전에 의도한 대로 작용하고 있는가? 의도한 변화가 나타나는가? 새로 확인된 영향은 무엇인가? 그 이유는 무엇인가? 어떻게 개선할 수 있는가? 의도하지 않은 결과가 발생했는가?
중기분석은 시행 과정에서의 지속적인 개선을 목적으로 개입의 시행과 새롭게 나타난 결과에 대한 근거를 제시한다.
사후분석 – 개입이 효과가 있었는가? 효과는 어느 정도인가? 비용 측면에서는 어떠 한가? 설계 및 시행 과정에서 배울 수 있는 점은 무엇인가? 개입으로 인한 변화는 지속되고 있는가?
사후분석은 설계, 시행 및 결과에 대한 근거를 제시하고, 이를 통해 향후 활용할 수 있는 교훈 도출, 개입으로 인한 전반적인 영향에 대한 평가를 수행한다.
