French term

relever et garantir

French to English Law/Patents Law: Patents, Trademarks, Copyright court case for infringement
Company A is summoned to court for having supposedly sold infringing MP3 players via the internet. But A wants to join the website company to the proceedings, and requests that said company B be sentenced to" relever et garantir la société A de toutes sommes pouvant etre mis à sa charge."

Discussion

Attorney DC Bar Nov 17, 2007:
Dianne, for your translation, note that you join a defendant IN and not TO proceedings, and that company B cannot be 'SENTENCED' to do anything, since this is not a criminal proceeding, rather it will be 'ORDERED' to release and hold company A harmless.:)

agree AllegroTrans : yes, but I don't think asker's "sentenced" would be appropriate, maybe "bound"

{make a contribution} relieving and indemnifying

Release and hold harmless is already in the Glossary.

Contribution proceedings precede a co-defendant scenario: i.e. X makes A & B co-defendants.

Third party (UK = Part 20) proceedings: X sues A who joins in B as a third party for a 'contribution and an indemnity' - neither a release nor a guarantee.

Example sentence:

Defendant’s additional claim for contribution or indemnity from .... part of proceedings be dealt with as separate proceedings and to decide the ...
