French term
existence
French to English

Corporate Governance
"Au sujet du conseil, la société publie :
- une description de la structure de gouvernance de la société
- les éléments essentiels du régime de gouvernance d’entreprise tels que consignés dans le règlement d'ordre intérieur du conseil d’administration
- la politique établie par le conseil d’administration pour les transactions sur les titres de la société et les autres relations contractuelles
- l'existence et la nature du système de gestion des risques"
'Publie' is 'discloses' in this context. I'm finding the translation of 'existence' awkward here. "Should disclose the existence of..." does not sound quite right!

whether there is any...
perhaps you could reword it to something like
...whether there is any risk management system in place, and if so, what type..

: "the nature of any RMS that may exist" - bit more formal, keeps the element of 'doubt' that 'existence' implies, includes an 'exist-' word (!) - I'm sure you were heading in this direction with this answer + your comment to reubenius :-)

I think that it sounds fine. Although you do not need to say 'should disclose' - you have 'the company discloses:'
in the first line and then a list.
....the company discloses:
* A
* B
*The existence....
Maybe its a fluffy way of saying that they disclose risks/liabilities that have been identified

what about leaving it out?
It's another idea -if you disclose the nature of your risk management system then it must, a priori, exist (or am I getting all ontological!)

I also think 'the existence' sounds fine, as Julie says above.
